Terms of Service

1. Acceptance of Terms

By using DispatchX (the "Bot"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Bot. DispatchX is provided by the development team (the "Developer") and is designed to enhance roleplay experiences for Emergency Response: Liberty County (ERLC) Discord communities.

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Bot constitutes acceptance of the modified Terms.

2. License Grant

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use DispatchX in accordance with these Terms. You may not:

• Modify, reverse engineer, or create derivative works of the Bot
• Sublicense, resell, or commercially distribute the Bot
• Use the Bot for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Bot's systems
• Use the Bot to harm, harass, or exploit others

3. User Responsibilities

3.1 Lawful Use

You agree to use DispatchX only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their enjoyment of the Bot. You acknowledge that the Bot is intended for roleplay purposes only and should not be used for actual emergency services coordination.

3.2 Discord Terms Compliance

Your use of DispatchX is subject to Discord's Terms of Service and Community Guidelines. You agree to comply with all Discord policies and any server rules established by server administrators. Any violation of Discord's Terms will result in your account being banned from using the Bot.

3.3 Prohibited Content

You agree not to use the Bot to:

• Post, transmit, or distribute illegal content
• Harass, bully, or threaten other users
• Distribute malware, spam, or malicious code
• Impersonate others or create misleading content
• Violate intellectual property or privacy rights
• Engage in doxxing, swatting, or similar harmful activities

3.4 Account Security

You are responsible for maintaining the security of your Discord account. You agree not to share your account credentials and to take reasonable steps to protect your account from unauthorized access. The Developer is not responsible for any actions taken through your account.

4. Server Administration

4.1 Administrator Authority

Server administrators retain full authority over DispatchX settings within their server. Administrators may:

• Configure bot permissions and settings
• Remove the Bot from their server at any time
• Override or modify Bot functionality through server rules
• Remove or restrict users from using the Bot

4.2 Server Owner Responsibility

Server owners are responsible for implementing and enforcing rules governing Bot use within their community. The Developer is not responsible for the actions of server members or content generated through Bot usage.

4.3 Data Management

Administrators acknowledge that dispatch data, logs, and configurations stored by the Bot are the property of the server. Administrators are responsible for managing this data appropriately.

5. Intellectual Property Rights

5.1 Developer Rights

DispatchX and all content, features, and functionality (including but not limited to code, design, and graphics) are owned by the Developer and are protected by international copyright, trademark, and other intellectual property laws.

5.2 User Content

You retain ownership of any content you create using DispatchX. By using the Bot, you grant the Developer a limited license to store and process your content for Bot functionality purposes only.

5.3 Trademarks

DispatchX, the DispatchX logo, and all related marks are trademarks of the Developer. You may not use these trademarks without prior written permission.

6. Disclaimer of Warranties

The Developer makes no warranty that:

• The Bot will meet your requirements
• The Bot will be uninterrupted, timely, or error-free
• Any defects in the Bot will be corrected
• The Bot is free from viruses or other harmful components
• The results from use of the Bot will be accurate or reliable

You use the Bot at your own risk and discretion.

7. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Use or inability to use the Bot
• Loss of data or information
• Unauthorized access or alteration of your data
• Any third-party conduct or content
• Any other matter relating to the Bot

This limitation applies regardless of whether the Developer has been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:

• Your use of the Bot
• Your violation of these Terms
• Your violation of Discord's Terms of Service
• Your violation of any applicable laws or regulations
• Your content or conduct

9. Service Availability

9.1 Uptime and Maintenance

While we strive to provide reliable service, the Developer does not guarantee 100% uptime. The Bot may be unavailable due to:

• Scheduled maintenance and updates
• Emergency maintenance
• Technical issues or server failures
• Discord API issues or outages
• Other technical circumstances beyond our control

9.2 Service Termination

The Developer reserves the right to:

• Discontinue, suspend, or modify the Bot at any time
• Remove users who violate these Terms
• Ban servers that violate these Terms from using the Bot

9.3 Data Loss

The Developer is not responsible for loss of data resulting from service discontinuation. We recommend maintaining backups of important dispatch data.

10. Third-Party Services

10.1 Discord

DispatchX operates through Discord's platform and API. Your use is subject to Discord's Terms of Service and Privacy Policy. The Developer is not responsible for Discord's actions or policies.

10.2 External Links

The website and Bot may contain links to third-party services. The Developer is not responsible for the content, accuracy, or practices of external websites.

10.3 Third-Party Compliance

You are responsible for complying with all third-party services' terms and policies, including but not limited to Discord, Roblox, and ERLC.

11. Payment Terms

11.1 Free Service

DispatchX is provided as a free service. However, premium features may become available in the future.

11.2 Premium Features

If premium features become available, purchases are final and non-refundable. Subscriptions will automatically renew unless cancelled. Users are responsible for managing their subscriptions.

11.3 Price Changes

The Developer reserves the right to change pricing for premium features with notice.

12. Dispute Resolution

12.1 Informal Resolution

If you have a dispute with the Developer, please contact us first to attempt resolution informally through our support channels.

12.2 Governing Law

These Terms are governed by applicable law. Any legal disputes arising from these Terms shall be subject to the jurisdiction of the appropriate courts.

12.3 Severability

If any part of these Terms is found to be invalid or unenforceable, that portion will be severed, and the remaining Terms will remain in full force and effect.

Sections that should logically survive termination (such as Intellectual Property, Limitation of Liability, and Indemnification) shall survive termination of these Terms.
